Page 685 Page 686 Page 687 Defendant was convicted of murder following a jury trial in the circuit court of Kane County in violation of section 9-1(a)(1) of the Criminal Code of 1961 (Ill. Rev. Stat. 1981, ch. 38, par. 9-1(a)(1)). He was sentenced to 20 years imprisonment. On appeal he contends that: (1) the State did not sustain its burden of disproving self-defense beyond a reasonable doubt; (2) the trial court abused its discretion in denying defendants motion for a mistrial where the State failed to disclose a statement of defendants; (3) the trial court abused its discretion in denying defendants motion for a mistrial where the arresting officer alluded to defendants involvement in other crimes of a similar nature; and, (4) the prosecutors cross-examination of defendant and closing argument regarding defendants post-arrest, post-warning silence violated defendants right to due process. We reverse.
